Anti-Money Laundering (AML) Policy

  1. SCOPE AND APPLICABILITY
  1. The Jeev Atma Foundation (“Foundation”) is committed to ethical business practices and compliance with all applicable laws. This Anti-Money Laundering (“AML”) Policy is designed to prevent the misuse of our platform for illegal financial activities, including money laundering and terrorist financing. All users must comply with this policy in addition to their obligations under applicable laws.
  2. Users of the Jeev Atma Foundation platform, including donors, contributors, campaigners, and visitors (collectively referred to as “Users”), are required to report any suspicious activity to the relevant authorities.
  1. WHAT CONSTITUTES MONEY LAUNDERING AND SUSPICIOUS TRANSACTIONS
  1. “Money laundering” refers to the process of concealing the origins of money obtained illegally, making it appear as if it originates from legitimate sources. This is often associated with criminal activities such as fraud, bribery, terrorism, and smuggling.
  2. The following are examples of suspicious activities that may indicate money laundering:
    • Users unwilling to provide complete or accurate information.
    • Large donations that are inconsistent with normal patterns of contribution.
    • Multiple partial payments from different sources for a single user.
    • Users making contributions followed by immediate withdrawal requests.
    • Requests to transfer funds to third parties without clear purposes.
    • Attempts to bypass verification or reporting requirements.

III. STEPS TO ENSURE COMPLIANCE

  1. Compliance with Laws: Users must ensure that all transactions comply with applicable local and international laws. Funds contributed to the Foundation must not originate from unlawful activities.
  2. User Verification: The Foundation may require Users to provide identification documents such as government-issued IDs to verify their identity and source of funds.
  3. Monitoring and Reporting: Users must report any suspicious transactions or activities to the appropriate authorities. The Foundation will also conduct internal audits to detect and prevent money laundering.
  1. ACTION BY JEEV ATMA FOUNDATION

If any suspicious activity or policy violation is identified, the Foundation may take the following actions:

  • Investigate the transaction and gather relevant information.
  • Report the incident to law enforcement authorities.
  • Suspend or terminate the associated user account.
  • Block or reverse transactions as necessary.
  1. CONSEQUENCES OF AML POLICY VIOLATIONS
  1. Violation of this AML Policy may result in immediate account suspension, legal action, and potential financial penalties.
  2. Users acknowledge that non-compliance with AML regulations can cause severe legal and reputational risks for the Foundation.
  1. NO LIABILITY

The Jeev Atma Foundation shall not be liable for any illegal transactions carried out by users on its platform. The Foundation also reserves the right to take necessary legal actions against any individual or entity violating this policy.

VII. COOPERATION AND COMPLIANCE

Users must cooperate with the Foundation, law enforcement agencies, and regulatory bodies in any investigation or inquiry related to AML compliance.

VIII. RECORD MAINTENANCE AND DISCLOSURE

  1. The Foundation will maintain records of user transactions, identity verifications, and any suspicious activities for a legally required period.
  2. The Foundation reserves the right to disclose such records to regulatory authorities as part of legal or compliance obligations.

The Jeev Atma Foundation reserves the right to update this AML Policy at any time. Users will be notified of significant changes, and continued use of our platform constitutes acceptance of the updated policy.

Any dispute related to this AML Policy shall be governed by the laws of India and subject to the jurisdiction of courts in Gurugram, Haryana.
